Özet
Katar’da1 alanında ilk olma özelliğine sahip, 22 sayılı ve 29/06/2006 tarihli “Katar Aile Kanunu”, beş ana bölümden (kitâb) ve 304 maddeden oluşmaktadır. Bu çalışma kanunun sadece ayrılık şekillerini (talâk, Muhâlea ve tefrik) ihtiva eden II. bölümünü ele almış ve İslam hukuku açısından değerlendirmiştir. Bunu yaparken, çalışma fıkhî mezheplerin ilgili kanuna ne kadar tesir ettiğini, daha ziyade hangi mezhebin dikkate alındığını belirlemeye çalışmış ve yer yer 1917 tarihinde farklı mezheplerden telfîk usulü ile yasalaştırılan Osmanlı Hukuk-ı Aile Kararnamesi’ne atıflar yapmıştır. Böylece mukayeseli hukuk çalışmalarına katkıda bulunmayı hedeflemiştir. Kanunun toplumda meydana getirdiği etkiyi tespit için basınyayına müracaat edilmiştir. Araştırma neticesinde ilgili kanunun genelde Hanbelî mezhebini esas aldığı ancak bazı konularda İbn Teymiyye’nin (ö. 728/1328) yaklaşımlarını tercih ettiği görülmüştür. Kanunda farklı mezhep ve inançtaki insanlara adlî muhtariyet tanınmıştır. Kadın ve ailenin saygınlığı, korunması ve mahremiyetine önem verilmiş, hakimlerin yargılama yanında ıslah görevine de dikkat çekilmiştir
Abstract
“Code of Qatar Family Law” (Law Code No: 22, Date: June 29, 2006) which has the distinctive feature of becoming the first in its field in Qatar is comprised of five main parts (books) and contains 304 articles in total. This study covered the second part of the law code which addressed only the forms of divorce (talaq/repudiation, khul/mutual divorce, judicial divorce) and evaluated it in the context of Islamic law. In so doing, the study attempted to ascertain to what extent each Islamic school (madhhab) of jurisprudence (fiqh) affected the law code particularly endeavoring to find out which school of jurisprudence had strong influence on its legislation, and, on occasion, referred to Ottoman Family law which, in its enactment in 1917, benefited from views of different Islamic schools of jurisprudence through compilation method. Hence, the study aimed to contribute to the comparative legal research studies. In order to identify implications of the law code on Qatari society, Qatari press was analyzed. At the end of the research, it was discerned that the law code was constituted primarily on the basis of Hanbali school of jurisprudence. Approaches developed by Ibn Taymiyyah (DoD 728 AH / 1328 CE) were preferred in certain issues. In the law code, judicial autonomy was granted to people who were members of different madhhabs and beliefs. Moreover, importance was attached to the prestige, protection and privacy of woman and family, and attention was drawn to the correctional duty of judges as well as their judicial duties.
