THE LIASON OFFICE AND CHARACTERISTICS IN TURKISH LAW

Abstract

To observe business opportunities in Turkey and desire to test the market and also at this stage, foreign investors who do not want to start trading activities immediately, can benefit from a significant opportunity recognized by the law to open a liaison office. Legal arrangements regarding the liaison office were made with the “Direct Foreign Investment Law” and “Implementation Regulation on Foreign Direct Investment Law numbered 4875”. The authority to grant permission for a foreign company to open a liaison office is the Ministry of Economy, General Directorate of Incentive Implementation and Foreign Investments.

Özet

Türkiye’deki iş imkânlarını gözlemlemek ve pazarı test etmek isteyen, bu aşamada da ticari faaliyetlere hemen başlamak istemeyen yabancı yatırımcılar yasanın tanıdığı önemli bir imkândan yararlanabilmekte, irtibat bürosu (liaison office) açmaktadırlar. İrtibat bürosuna dair hukuki düzenleme, “4875 sayılı Doğrudan Yabancı Yatırımlar Kanunu” ve “Doğrudan Yabancı Yatırımlar Kanunu Uygulama Yönetmeliği” ile yapılmıştır. Yabancı bir şirketin irtibat bürosu açmasına izin verme ve bu izinlerin sürelerini uzatma yetkisi, Ekonomi Bakanlığı, Teşvik Uygulama ve Yabancı Sermaye Genel Müdürlüğü’ne verilmiştir.
