THE COMMENCING ACTS OF EXECUTIONS AS AN OBJECTIVE ELEMENT OF CRIMINAL ATTEMPT AND THE PROBLEMS IN PRACTICE

Abstract
After a certain point, criminal law interferes and applies sanctions to the actions of a perpetrator along criminal way (iter criminis ) in order to protect the public order. In principle, the process of consideration and preparation phase have become the are- as of freedom for a perpetrator. A perpetrator becomes the subject of the criminal law whenever he/she begins the acts of execution within the regulations related to criminal attempt. When an action goes beyond preparation and finally becomes acts of execution then this action is named as a criminal attempt and by this way, this action has become punishable. Actually, the distinction between a preparatory act and an act of execution has a feature of identification of punishable action. In this article, this problem which has wide range arguments in doctrine and practice will be evaluated within the framework of judgments of Court of Cassation.
Özet
Ceza hukuku, toplum düzeninin korunması amacıyla suç yolunda (iter crimi- nis) ilerleyen failin fiiline bir noktadan itibaren müdahale ederek yaptırıma tabi tutar. Düşünce aşaması ve kural olarak hazırlık aşaması failin özgürlük alanıdır. Fail teşebbüs düzenlemesi ile icra hareketlerine başladığı an ceza hukukunun müdahale alanına girer. Bir eylem ancak hazırlık hareketi boyutunu aşarak icra hareketi niteliğine ulaştığında teşebbüs gerçekleşmiş olur ve cezalandırılır. Hazırlık hareketi-icra hareketi ayrımı esas olarak cezalandırılabilir fiilin tespiti niteliği taşımaktadır. Bu çalışmada doktrinde ve uy- gulamada birçok tartışmayı bünyesinde barındıran bu sorun Yargıtay içtihatları ışığında değerlendirilecektir.
