LEGAL CHARACTER OF CERTIFICATE OF WARRANTY PURSUANT TO COMMENTARY ON THE CONSUMER PROTECTION LAW NO: 6502

Abstract
The Warranty Document has been regulated by the Commentary on the Consumer Protection Law No: 6502, article 56. This regulated warranty is an obligated warranty. The Certificate of Warrant of Manufacturers and importers are obliged to prepare a warranty document for the consumer products and imported goods, content of which being specified by the regulation. The goods which must be sold with a warranty document is defined by the regulation. Vendor, on the other hand, is responsible for the maturation and delivery of this document to the consumer. Manufacturers and importers are responsible for the certain industrial goods as guarantor. On the other side, within the scope of liabilty for defective goods, according to article 11; they are also responsible for repairment of the good free of charge or replacement with a nondefective and fungible good. There are two legal relationships for the certain industrial goods, one of it from the defective goods, and the other one from the obligated warranty for the consumer. However, in some articles the legislator has made arrangements without considering this issue. There is no obligated warranty in European Union Law, however there is voluntary commercial guarantee. There are some different opinions over the legal character of obligated guarantee. We agree with the opinion of legal obligation, so there is a legal relationship between the buyer (acguirer) and the manufacturer or the importer from the legal obligation. The practise of court of cassation is the same, even if court of cassation doesn't agree with this opinion of legal obligation or any other opinion.

Garanti belgesi 6502 sayılı Tüketicinin Korunması Hakkında Kanun m. 56'da düzenlenmiştir. Bu maddede düzenlenmiş bulunan garanti, zorunlu garantidir. Üretici ve ithalatçılar, tüketiciye yönelik üretilen veya ithal edilen mallar için içeriği yönetmelikle belirlenen bir garanti belgesi düzenlemek zorundadır. Hangi malların garanti belgesiyle satılmak zorunda olduğu da, Garanti Belgesi Yönetmeliği'nde belirlenmiştir. Bu belgenin tekemmül ettirilerek tüketiciye verilmesi sorumluluğu satıcıya aittir. Üretici ve ithalatçı belirli mallar için garanti veren olarak sorumludur. Bunun dışında, ayıptan doğan sorumluluk çerçevesinde, m. 11 bağlamında ücretsiz onarım ve malın ayıpsız misliyle değiştirilmesi haklarının da borçlusu olarak düzenlenmiştir. Zorunlu garantiye tabi mallar bakımından, tüketici açısından, biri ayıptan doğan, diğeri zorunlu garantiden doğan sorumluluk olmak üzere iki ayrı hukuki ilişki ortaya çıkmaktadır. Bununla birlikte, Kanun koyucu, bazı hükümlerde iki ayrı hukuki ilişki olduğunu gözetmeden düzenleme yapmıştır. AB hukukunda zorunlu garanti uygulaması yoktur, garanti ilişkisi gönüllülük esasına dayanmaktadır. Zorunlu garantinin hukuki niteliği hususunda farklı görüşler mevcuttur. Biz zorunlu garantinin kanundan doğan bir borç olduğu, malı edinenle garanti veren (üretici veya ithalatçı) arasında kanundan doğan bir borç ilişkisinin doğduğu görüşüne katılıyoruz. Yargıtay'ın uygulaması da -her ne kadar kanundan doğan borç ilişkisine ya da diğer başka bir görüşe istinat etmese de- bu yöndedir.
