ELEMENTS OF RESPONSIBILITY ARISING FROM NEIGHBORHOOD RELATIONS IN ROMAN LAW

Abstract

Due to the neighborly relations of the immovable owner, landowner’sliabilitywas accepted in Roman law as it is today. The owner of the immovable property may harm others when using the property right and may violate public or private law interests. In fact, because the owner usesthe property right, the unlawful behavior cannot be mentioned. However, this use may adversely affect the use of other rights holders, interferences such as dust, smoke, odor, noise and moisture caused by the use of the owner’s estate may damage other immovable property owners. Landowner’s liability has in situaiton of using contrary to legalrestrictions of landowner’s property right.The effects arising from the exercise of the right to property have emerged as a problem in Roman law since Law of the Twelve Tables. The use of the property right to solve the problem is restricted. The landowner, who acted against these limitations, was held liable for the damages he incurred.

Taşınmaz malikinin komşuluk ilişkileri sebebiyle sorumluluğu günümüzdeki gibi Roma hukukunda da kabul edilmiştir. Taşınmaz maliki mülkiyet hakkını kullanırken başkalarına zarar verebilir, kamu hukuku ya da özel hukuk menfaatlerini ihlal edebilir. Aslında malik, mülkiyet hakkını kullandığı için hukuka aykırı davranışından söz edilemez. Fakat bu kullanım başka hak sahiplerinin kullanımlarını olumsuz yönde etkileyebilir, mesela malikin taşınmazını kullanırken sebep olduğu toz, duman, koku, gürültü, rutubet gibi müdahaleler diğer taşınmaz maliklerine zarar verebilir. Taşınmaz malikinin mülkiyet hakkını yasal kısıtlamalarına aykırı kullanması halinde sorumluluğu söz konusudur. Mülkiyet hakkının kullanımından kaynaklanan etkiler, Roma hukukunda, On İki Levha Kanunları’ndan beri bir sorun olarak ortaya çıkmıştır. Sorunu çözmek için mülkiyet hakkının kullanımı kısıtlanmıştır. Bu sınırlamalara aykırı davranan malik verdiği zararlardan dolayı sorumlu tutulmuştur.
