THE VIEWS AND GENERAL COMMENTS OF THE UNITED NATIONS COMMITTEE ON THE RIGHTS OF PERSONS WITH DISABILITIES

BİRLEŞMİŞ MİLLETLER ENGELLİ HAKLARI KOMİTESİ’NİN KARAR VE GENEL YORUMLARI

Abstract

The most important documents adopted by the United Nations, in the field of disability rights, are the Convention on the Rights of Persons with Disabilities and Optional Protocol. The monitoring of implemantation of the Convention’s provisions at the States Parties has given to the Committee on the Rights of Persons with Disabilities. The tasks of the Committee are to review the State Parties reports, to conduct an inquiry about the States Parties that violate the Convention in a grave and systematic way, to prepare General Comments and to examine individual complaints with regard to alleged violations of the Convention by States parties. In this study, the Committee’s views with regard to alleged violations of the Convention and General Comments of the Committee have been reviewed.

Özet

Birleşmiş Milletler’in engelli hakları alanında kabul etmiş olduğu belgeler içinde en önemli belge Engelli Hakları Sözleşmesi ile Seçmeli Protokol’dür. Sözleşme’nin hükümlerinin Sözleşme’ye taraf olan devletlerde uygulanmasını izleme görevi bu amaçla kurulmuş olan Engelli Hakları Komitesi’ne verilmiştir. Komitenin görevleri; taraf devletlerce sunulan raporları incelemek, Sözleşme’yi ağır ve sistematik şekilde ihlal ettiği iddia edilen devletler hakkında soruşturma yürütmek, Genel Yorumlar kabul etmek ve Sözleşme’de düzenlenen hakların ihlalleri konusunda yapılan bireysel şikayetleri incelemektir. Bu çalışmada, Birleşmiş Milletler Engelli Hakların Komitesi’nin kurulduğu günden beri kabul etmiş olduğu Genel Yorumlar ile Sözleşme’de yer alan hakların ihlaline ilişkin yapılan bireysel şikayetler hakkında verdiği kararlar incelenmiştir
