PROTECTION WAYS AND VIOLATION OF THE PERSONAL DATA OF EMPLOYEES’ ESPECIALLY IN SCOPE OF PERSONAL DATA PROTECTION CODE

ÖZELLİKLE KİŞİSEL VERİLERİN KORUNMASI KANUNU ÇERÇEVESİNDE İŞÇİLERİN KİŞİSEL VERİLERİNİN İHLÂLİ VE KORUNMASI YOLLARI

Abstract

As the place they take in work life, one of the groups whose rights are violated most in terms of personal data processing and storage is employees. In this regard, the protection of personal data is needed. This protection shall be provided by the provisions of Constitution, Turkish Code of Obligations, Turkish Criminal Code and Labor Code. In addition to that, personal data owned a special regulation for the first time with the entry into force of Personal Data Protection Code. Undoubtedly that, these provisions will be applied to employees. For this purpose, the protection ways and violation of personal data protection of employees’ in scope of Personal Data Protection Code shall be examined.

Özet

İş yaşamında bulundukları konum sebebiyle, kişisel verilerin işlenmesi ve depolanması bakımından en çok hak ihlaline uğrayan gruplardan biri de işçilerdir. Bu bakımdan işçilerin kişisel verilerinin korunması gerekmektedir. Bu koruma, Anayasa, Türk Borçlar Kanunu, Türk Ceza Kanunu ve İş Kanunu’nda yer alan birtakım hükümlerle sağlanabilmektedir. Buna ek olarak, Kişisel Verilerin Korunması Kanunu’nun yürürlüğe girmesi ile de kişisel veriler ilk defa özel bir düzenlemeye kavuşmuştur. Şüphesiz ki bu hükümler işçiler bakımından da uygulama alanı bulacaktır. Bu amaçla işçilerin Kişisel Verilerin Korunması Kanunu bakımından da kişisel verilerinin ihlâli ve korunması yolları incelenmelidir.
