“WOMAN” IN THE 1982 CONSTITUTION AND IN THE DECISIONS OF TURKISH CONSTITUTIONAL COURT

Abstract

The status of the woman in a constitution is one of the most important indicators of how political powers are limited in a constitutional state and how fundamental rights and freedoms are protected. In article 10, entitled “equality before the law” of the 1982 Constitution, equality between men and women was reinforced through the amendments made in 2004 and 2010. With these regulations, importantsteps have been taken towards consolidating the principle of positive discrimination. However, the view of the 1982 Constitution on woman is not limited to just the principle of equality, and it is necessary to consider these provisions within the framework of the decisions of the Constitutional Court. Paternal and masculine discourses have already become the most important determinant of women status and rights.

Özet

Anayasada kadının statüsü, bir anayasal devlette siyasi iktidarların nasıl sınırlandığının ve temel hak ve özgürlüklerin nasıl korunduğunun önemli göstergelerinden biridir. 1982 Anayasasının “kanun önünde eşitlik” başlıklı 10.maddesinde, 2004 ve 2010 yılında yapılan değişiklikler yoluyla kadın ve erkek eşitliği pekiştirilmiştir. Bu düzenlemeler ile pozitif ayrımcılık ilkesinin belirginleşmesi yolunda önemli adımlar atılmıştır. Ancak 1982 Anayasasının kadına bakışı, sadece eşitlik ilkesi ile sınırlı değildir ve bu hükümleri Anayasa Mahkemesinin kararları çerçevesinde değerlendirmek gerekir. Paternal ve eril söylem, kadının statüsünün ve haklarının en önemli belirleyicisi haline gelmektedir.
