THE HAGUE CONVENTION OF 1980 ON THE CIVIL ASPECTS OF INTERNATIONAL CHILD ABDUCTION AND THE IMPLEMENTATION IN TURKEY

Abstract

What should be done if the person you marry abducts your joint child to another country without your permission? What are the steps to be taken in this event that may constitute an international child abduction? In this case, the Hague Convention on the Civil Aspects of International Child Abduction should be applied and return of the child should be requested. This study has been prepared in order to contribute to the understanding of the Convention by addressing the Hague Convention and the relevant legislation in Turkey and to suggest solutions to problems in practice. In this study, firstly, the general principles, purpose and the applicability of the Hague Convention and the principles regarding the return process have been examined. Subsequently, the implementation of the Convention in Turkey and emerging issues have been mentioned. Especially, issues in the relationship between return and custody cases and the execution of the return order which arise in practice have been indicated and solution recommendations have been made.

Evlendiğiniz kişi, ortak çocuğunuzu sizden izinsiz başka bir ülkeye kaçırırsa ne yapılması gerekir? Uluslararası çocuk kaçırma vakası teşkil edebilecek bu olayda izlenmesi gereken adımlar nelerdir? Bu durumda Uluslararası Çocuk Kaçırmanın Hukuki Yönlerine Dair Lahey Sözleşmesi’ne başvurulması ve çocuğun iadesinin talep edilmesi gerekir. Bu çalışma, Lahey Sözleşmesi’ni veTürkiye’deki ilgili mevzuatı genel hatlarıyla ele alarak Sözleşme’nin anlaşılmasına katkısağlamak ve uygulamadakisorunlara çözüm önerilerinde bulunmak amacıyla hazırlanmıştır. Çalışmada öncelikle Lahey Sözleşmesi’nin genel esasları, amacı ve uygulanabilirliği ile iade sürecine ilişkin esaslar incelenmiştir. Daha sonra Sözleşme’nin Türkiye’deki uygulamalarına ve ortaya çıkan sorunlara değinilmiştir. Özellikle Türkiye’de iade ve velayet davalarının ilişkisi ile iade kararının icrası hususunda uygulamada ortaya çıkan sorunlar belirtilmiş ve çözüm önerilerinde bulunulmuştur.
