Planning powers vested in the privatization administration

Abstract

The Privatization Administration has recently become one of the central public organizations with important planning powers. This is the outcome of increasing number of privatization practices, pressures from interest groups, and current legal obstructions. The administration attempts to sell the properties subject to privatization with the highest amount possible. On the other hand, development plans in the parcel scale prepared by the administration for this purpose in most cases impair the integrity of urban plan, increase construction intensity and challenge urban infrastructure services. In this study, while searching an answer to the question of why the Privatization Administration has a planning authority, it is also aimed to examine how the current powers are utilized in practice as well as the current applications in this context.

Günümüzde Özelleştirme idaresi, önemli planlama yetkilerine sahip merkezi kamu kurumlarından birisi haline gelmiştir. Bu durum artan özelleştirme uygulamalarının, rant baskısının ve yaşanan hukuki tıkanıklıkların bir sonucudur. İdare, özelleştirme kapsamındaki taşınmazları en yüksek fiyattan satma gayretindedir. Diğer taraftan, İdare 'nin bu amaca yönelik olarak hazırladığı parsel ölçeğindeki imar planları, çoğu zaman, kentin plan bütünlüğünü bozucu, yapı yoğunluğunu artırıcı, kentsel altyapı hizmetlerini zorlayıcı niteliktedir. Bu çalışma, Özelleştirme idaresi 'nin neden planlama yetkilerine sahip olduğu sorusuna yanıt ararken, mevcut yetkilerin nasıl kullanıldığı ve yapılan uygulamaları da araştırmayı amaçlamaktadır.
