THEORY OF INTIMATION IN INTERPRETATION OF TESTAMENTS

Abstract

In the interpretation of testaments, it is aimed to achieve the real will of thelegator. In order to achieve the real will of the legator, the circumstances andconditions out of the testament should also be considered while interpreting. Onthe other hand, testaments are formal legal transactions. Theory of intimation isa theory suggested mainly in order to associate those two circumstances. Implementation of theory of intimation in terms of testaments is adopted as ageneral in the doctrine, despite contrary opinions. In our study, it is aimed toclarify the theory of intimation.
