Abstract
Nowadays, there is no doubt that all people have fundamental rights and freedoms, such as the right not to be tortured, only because they are human and everyone is equal to use these fundamental rights and freedoms. With the influence of the modern age, protection of these fundamental rights and freedoms and protection of the principle of non-discrimination which provides equal use of these rights became a necessity. Also with this influence, various protection and supervisory mechanisms were established both international and national areas. Even though it is considered that these mechanisms protect fundamental rights and freedoms tightly, we still come across many violations of these rights and freedoms in our country and in the world. In our study, X v. Turkey, which is the case of the European Court of Human Rights –established by the Council of Europe and one of the supervisory mechanism- is examined from the point of the prohibiton of torture and non-discrimination, which are the most important rights and have the jus cogens character. By the case in 2012, it is emphasized once again that we have deficiencies in providing of the most important fundamental rights and freedoms, despite the fact that they are at the forefront.
Özet
Günümüzde insanın sadece insan olmasından dolayı işkenceye uğramama hakkı gibi birtakım temel hak ve özgürlüklere sahip olduğu ve bu temel hak ve özgürlükleri kullanmada herkesin eşit olduğu şüphesizdir. Modern çağın etkisiyle bu temel hak ve özgürlükler ile bu hakların eşit olarak kullanımını sağlayan ayrımcılık yasağı ilkesinin korunması bir ihtiyaç olarak gündeme gelmiş ve gerek uluslararası gerek ulusal alanda çeşitli koruma ve denetim mekanizmaları kurulmuştur. Her ne kadar bu mekanizmaların, temel hak ve özgürlükleri sıkı bir şekilde koruduğu düşünülse de ülkemizde ve dünyada temel hak ve özgürlüklerin ihlalleri ile birçok kez karşılaşmaktayız. Bu ihlallerin önlenmesi amacıyla Avrupa Konseyi nezdinde kurulan ve uluslararası denetim mekanizmalarından biri olan Avrupa İnsan Hakları Mahkemesi’nin Türkiye aleyhine verdiği XTürkiye Kararı, çalışmamızda insanın en temel haklarından olan ve aynı zamanda jus cogens statüsüne sahip işkence yasağı ve ayrımcılık yasağı açısından incelenmiştir. Günümüzde insan haklarının son derece ön planda olmasına rağmen, 2012 yılında verilen bu karar ile ülkemizde en temel olan hak ve özgürlüklerin korunması konusunda dahi eksikliklerimizin olduğu bir kez daha vurgulanmıştır.
