FRAUD IN THE TURKISH CRIMINAL CODE

Abstract

Fraud has been a frequent crime since ancient times. In this context, Turkish Criminal Code has been involved in this crime in crimes against its property. The crime requires the perpetrator's fraudulent behavior. These fraudulent behaviors are carried out to enable the victim to hand over the value of a property to him by deceiving the victim. The perpetrator is thus able to obtain a benefit in favor of himself or someone else and this is done to the detriment of the victim. In our study, we tried to reveal the elements of this crime, taking into account the complex nature of this crime.

Özet

Dolandırıcılık çok eski zamanlardan beri sıklıkla işlenen bir suç olmuştur. Bu çerçevede TCK’da da malvarlığına karşı suçlar içinde bu suça yer verilmiştir. Suç failin hileli bir takım davranışlarını gerektirmektedir. Bu hileli davranışlar mağduru aldatarak bir malvarlığı değerini kendisine teslim etmesini sağlamak amacıyla yapılmaktadır. Fail böylelikle kendisi ya da bir başkası lehine bir yarar elde etmekte ve bu mağdurun zararına gerçekleşmektedir. Çalışmamızda bu suçun karmaşık yapısını da dikkate alarak unsurlarını ortaya koymaya çaba gösterdik.
