PRELIMINARY EXAMINATION IN APPEAL PROCEEDING ACCORDING TO CODE OF CIVIL PROCEDURE

Abstract
In Turkish civil procedure law, the system of legal remedies has changed in 20.07.2016; and the legal remedy system with single-degree which had been implemented for many years, has been supplanted by double-degree system including appeal and cassation. In accordance with this change, the procedure rules of appellate courts, which will work as ruling courts differently from the Court ofCassation, is described in detail by Code of Civil Procedure (CPC). Therefore, the stages of appeal is divided into two parts as preliminary examination and examination. This structure is similar to the court of first instances. By that, firstly the case would be generally examined and then the legal dispute would be examined in detail. In this study, content of the preliminary examination and the decisions can be taken in this stage will be underlined. Furthermore, solutions to possible problems and debates are tried to be expressed.

Türk medenî yargılama hukukunda, 20.07.2016 tarihinden itibaren kanun yolları sistemi değişmiş ve uzun süredir uygulanan tek dereceli kanun yolu sistemi terk edilerek, istinaf ve temyiz aşamalarından oluşan iki dereceli kanun yolu sistemine geçilmiştir. Buna uygun olarak, artık temyizden farklı olarak hüküm mahkemesi şeklinde çalışacak olan istinaf mahkemelerinin yargılama prosedürü de HMK’da detaylı bir şekilde yer açıklanmıştır. Buna göre istinaf mahkemelerinde yargılama süreci ön inceleme ve inceleme şeklinde ikiye ayrılmıştır. Dolayısıyla, ilk derece mahkemelerinde öngörülen usûle benzer bir sistem oluşturulmuş ve dosyanın önce genel olarak değerlendirildiği, daha sonra işin esasına girildiği bir sistem kabul edilmiştir. İşte bu çalışmada, istinaf yargılamasındaki ön inceleme aşamasının içeriği ve bu aşamada verilebilecek kararlara değinilerek; bu kapsamda yaşanabilecek sorunlara ve tartışmalara da çözüm önerileri getirilmeye çalışılacaktır.
