New constitutional-making process in the light of the historical common values

Abstract

Each segment of the society accepts that there is a democracy problem in Turkey. There are serious obstacles against the freedom of expression. Hate speech in the society is getting stronger. It is very hard to reach democratic values in the countries where there is hate speech. Turkey is administered by decrees having the force of law. The decree having the force of law is a tool for transfer of the legislative power. The current constitution, a result of coup d’etat which is dishonour in the history of Turkish nation must change. We must write a new constitution in the light of the founding philosophy of this country, founded as a result of the Independence War, a war of a nation as a whole.

Özet

Türkiye’de bir demokrasi sorunu olduğu toplumun bütün kesimleri tarafından kabul edilmektedir. İfade özgürlüğü önünde ciddi engeller vardır. Nefret söylemleri güçlenmektedir. Nefret söyleminin olduğu yerde demokratik değerlere ulaşmak zordur. Türkiye, kanun hükmünde kararnameler ile yönetilmektedir. Kanun hükmünde kararnameler ya- sama yetkisinin devir aracıdır. Türk milletinin geçmişine yakışmayan darbelerin ürünü olan bu Anayasa değişmelidir. Hep birlikte verdiğimiz Kurtuluş Savaşı ile kurulan bu devletin kuruluş felsefesine uygun olarak yeniden yazılmalıdır.
