L'elaboration de la constitution dans le processus de la democratisation

Abstract

ABSTRACT The elaboration of a Constitution may be a break with the past and a new start, or it may be placed within a continuously moving framework thus accommodating the final objective of a constitutional renewal. Democratisation may also be a vague concept to the extent where it may refer to the reinforcement of an already existing democracy or to the passage between an authoritarian regime and a democratic one. This paper modestly intends to present the main stages of the Romanian transition towards a constitutional democracy and to end up with a brief sketch of the currently pending revision of the Constitution. RESUME L’élaboration d’une Constitution peut avoir la signification d’une rupture avec le passé et un départ ex novo, ou bien elle peut se placer dans un cadre continuellement aménagé afin d’accommoder l’objectif final du renouvellement constitutionnel. Le terme démocratisation aussi peut s’avérer équivoque, dans la mesure où il peut renvoyer soit à un renforcement d’une démocratie déjà existante, soit à un véritable passage d’un régime autoritaire à un régime démocratique. Cette contribution se propose de faire une brève présentation des principales étapes de la transition roumaine vers la démocratie constitutionnelle, et de finir par un rapide survol de l’actuel processus de révision de la Constitution.

Anayasa hazırlamak, geçmişle kopuş ve ex novo bir başlangıç anlamına gelebileceği gibi, anayasanın yenilenmesinin nihaî hedefine varmak için yapılan sürekli değişimlerin bir parçası da olabilir. Ayrıca demokratikleşme teriminin de, mevcut bir demokrasinin güçlendiril- mesini ya da otoriter bir rejimden demokratik bir rejime geçişi anlatması bakımından ikili bir anlamı olabilmektedir. Bu yazı, Romanya’nın anayasal demokrasiye geçişindeki temel aşamaları kısaca sunacak ve bu- günkü anayasa değişikliği sürecinin hızlı bir anlatımıyla son bulacaktır.
