Constituent/constituted power: theory and application

Abstract

This paper develops some principle ideas of Montesquieu who says that the legislature has to follow the spirit of the nation except for some fundamental principles which should always be respected. These princi- ples are defined by the rule of law which needs also to be respected as general limits of the sovereign. In addition the paper shows the different concepts of the nation and makes some fundamental proposals which should be respected in order to prevent either the tyranny of the majority or the tyranny of the minorities.

Bu yazı Montesquieu’nün, yasamanın, her zaman uyulması gere- ken bazı temel ilkeler dışında ulusun ruhunu izlemesi gerektiğini söyle- yen bazı temel görüşlerini incelemektedir. Bu ilkeler, egemenin genel sınırları olarak uyulması gereken hukukun üstünlüğü ile belirlenir. Ay- rıca yazı, farklı ulus kavramlarını göstererek hem azınlığın hem çoğun- luğun tiranlığını önlemek için uyulması gereken bazı temel önerileri ortaya koymaktadır.
