Bülent tanör and social rights in constitutional law

Abstract

Although social rights in constitutional law have an important place in both the political struggle and fundemental rights regime, it has been a less studied subject in Turkey. The attention given to other rights has been spared from social rights. One important reason for this has been the fact that it has been added to the classical liberal rights and freedoms bundle by the ever growing labor movement as of 19th century. It is possible to think that many lawyers working in social rights-related fields have treated social rights as a stepson because of this historical background and the level of class struggle in Turkey. The labor masses made their voice heard strongly in the political scene at the time of 1961 Constitution. This prominent work by Tanör is the product of the same era and discusses the social rights issue within the framework of politics-law relations and class struggle. In his work, Tanör delicately shows how a scientist with explicit political preference can approach his field within the framework of such preference, yet without deviating from the scientific method. Özet

Anayasa hukukunda sosyal haklar, gerek siyasal mücadelede ve gerekse temel haklar rejimi içinde son derece önemli yer tutmasına kar- şın Türkiye’de bugüne dek üzerinde çok çalışılmamış bir konudur. Diğer hak ve özgürlüklere gösterilen iltifat, sosyal haklardan esirgenmiştir. Bunun önemli bir gerekçesi, klasik-liberal hak ve özgürlükler demetine, 19.yüzyıldan itibaren giderek güçlenen emekçi hareketinin armağanı oluşudur. Bu tarihsel arka plan ve Türkiye’deki sınıf mücadelesinin ni- teliği nedeniyle, sosyal haklara ilgili alanlarda çalışan çoğu hukukçu tarafından üvey evlat muamelesi yapıldığı düşünülebilir. Türkiye’de işçi yığınlarının siyaset sahnesine gür bir sesle çıkışı, 1961 Anayasası döne- minde olmuştur. İşte Tanör’ün bu değerli eseri de aynı dönemin ürünü- dür ve sosyal haklar konusunu, siyaset-hukuk ilişkileri ve sınıf mücade- lesi bağlamında ele almaktadır.
