Abstract

Located in a high seismic risk area, Turkey endangers human life by allowing unhealthy and unsafe buildings to be built. To deal with this danger, the law on the transformation of areas at risk of disaster contains various provisions that restrict the right to property, the right to respect for private and family life and home and the right to enforce human rights. However, there are serious uncertainties about the constitutionality of these restrictions, because the law provides a “state of emergency” in the rules of ordinary law.

Özet

Yüksek deprem riski altında bulunan Türkiye’de yönetimler, gü- vensiz ve sağlıksız konutların inşa edilmesine izin vererek kişilerin ya- şama hakkını tehlikeye sokmuşlardır. Bu tehlikenin giderilmesi için ha- zırlanan 6306 sayılı Afet Riski Altındaki Alanların Dönüştürülmesi Hakkında Kanun mülkiyet hakkını, aileye, özel yaşama ve konuta saygı hakkını ve hak arama hürriyetini sınırlandıran düzenlemeler içermekte- dir. Ancak öngörülen sınırlamaların anayasaya uygunluğu konusunda ciddi şüpheler bulunmaktadır. Nitekim Yasa olağan hukuk kuralları içinde adeta “olağanüstü bir rejim” öngörmektedir.
