Abstract

ABSTRACT This paper deals with a key issue for contemporary democracy, namely the influence of governments over the democratic exercise of power by the sovereign people. It also deals with the possibility of the judiciary to review these direct manifestations of the sovereign people. The article is illustrated with the example that occurred in Romania, an East European country, where the incumbent president, Mr. Traian Basescu, tried to use his political influence in order to influence the results of his impeachment. Both in 2007 and in 2012 this allowed him to remain in power, the first time through a referendum validated with a turnout of less than 50% and the second time through a referendum invalidated precisely because its turnout was less than 50% of the total number of voters. RESUME Le présent article traite une question essentielle pour la démocratie contemporaine, à savoir celle de l'influence des pouvoirs publics sur l'exercice du pouvoir au cours des manifestations démocratiques du peuple souverain. En même temps, il s’agit de la possibilité dont dispose le pouvoir juridictionnel d'examiner ces manifestations directes du peuple souverain. Ces propos sont illustrés par l'exemple de la Roumanie, pays de l’Europe de l'Est, où le président de la république, M. Traian Basescu, a essayé d’utiliser son influence politique pour orienter les résultats du vote lors de la procédure relative à sa destitution. En 2007 tout comme en 2012 son attitude lui a permis de se maintenir au pouvoir, la première fois par un référendum confirmé avec un vote populaire dont la participation a été inférieure à 50%, et la deuxième fois par un référendum infirmé précisément parce que la participation a été en dessous de 50% sur l’ensemble de la population avec droit de vote.

Bu makale çağdaş demokrasi için önemli bir meseleyi ele alıyor : kamu otoritelerinin iktidarın egemen halk tarafından demokratik yollarla icrası üzerindeki etkisi. Makale, aynı zamanda, egemenliğin halk tara- fından doğrudan kullanılması üzerinde yargı denetiminin mümkün olup olmadığını irdeliyor. Bu çalışma, Cumhurbaşkanı Traian Basescu’nun, görevden alınmasına yönelik süreçte, siyasi gücünü oy sonuçlarını etki- lemek için kullanmaya çalıştığı bir doğu Avrupa ülkesi olan Romanya ile örneklendirilmiştir. Bu etki hem 2007’de hem de 2012’de -ilkinde % 50’den az bir katılımla gerçekleşen ve geçerli sayılan bir referandumla, ikincisinde ise oy hakkına sahip seçmenlerin % 50’sinden az bir katılım olduğu için geçersiz kılınan bir referandumla- Cumhurbaşkanının ikti- darda kalmasını sağlamıştır.
