Abortion:Stuck Between Law and Morality

Abstract

In today's society, the imposition of morality as law is a widespread opinion just because it's general acceptance. That the evaluation of abortion on moral grounds starts with the problem of coding the women as a mother. Furthermore, the fetus is defined as a child as to moral principles. In a society where the woman is not seen as a person but a mother, her decision about her body becomes unrecognizable. Since the abortion is not accepted as a right, it stuck between the rights of women and fetus. Against not noticing the abortion as a right, the position of law is the main research object of this essay.

Günümüz toplumlarında sadece genel olarak kabul görmesi nedeniyle ahlak kurallarının hukuk olarak dayatılması yaygın bir görüştür. Kürtajın ahlaki bakış açısından değerlendirilmesi kadının toplumda anne olarak kodlanması sorunsalıyla başlar. Bunun yanı sıra cenin toplumsal ahlak kuralları çerçevesinde çocuk olarak tanımlanır. Kadının bir birey olarak görülmediği bir toplumda kadının bedenine ilişkin kararı tanınmaz hale gelir. Bu durumda kürtaj, toplumda anne olarak görülen kadın ile çocuk olarak görülen ceninin haklarının yarışması kıskacında kalır. Kürtaj hakkının bir hak olarak görülmemesi karşısında hukukun konumu bu makalede incelenecek ana araştırma konusudur.
