(CURRENT CONSTITUTIONAL DEBATE REGARDING THE SUPREME ELECTION BOARD)

Abstract

In addition to the choice of an election system requirements to ensure fair representation in the elections, it is to election security issues one of the important issues discussed on today. The mechanism to provide election security is an independent judicial review. But in our country, although the election affairs to be managed and reviewed by the Supreme Election Board as an independent body, with a number of problems have been experienced in the management and supervizion of the elections. Constitutional problems with the reliability of the elections and solution proposals are trying to put forward in the article.

Seçimlerde temsilde adaleti de sağlayacak bir seçim sistemi tercihi gerekliliğinin yanısıra, bugün üzerinde tartışılan önemli konulardan bir tanesi de seçim güvenilirliğidir. Seçim güvenliğini sağlayacak mekanizma ise bağımsız bir yargısal denetimdir. Ülkemizde seçim işleri idareden bağımsız bir organ olan Yüksek Seçim Kurulu tarafından yönetilmek ve denetlenmekle birlikte, seçimlerin yönetimi ve denetimi konusunda birtakım sorunlar yaşanmaktadır. Makalede seçimlerin güvenilirliğine ilişkin anayasal sorunlar ve çözüm önerileri ortaya konmaya çalı- şılmaktadır.
