Looking Law Through Its Ideology: An Essay on Cosmopolitan, Territorial and State-Centered Discourses

Abstract
After the collapse of the Soviet Union, the void that emerged within the field of international law is started to being filled with the ‘chance discoveries’ of the legal theory and within this context the three main discoursive lanes are put to work within the production process that is appropriate to the new situation that emerged. These discursive lanes are gaining specific class context within the new situation aforementioned and the Thought concerned the international law is emerging within the discourses provided with the given class context. The functions of the makin axis’s that can be called Bourgeois-cosmopolitan, Territorial and State-Centered is being determined under the specific conditions of the Post-Soviet era. Within this context an understanding of a discourse of law is making imperative to look for the objective relations formed by it in its extra-discursive plane.
Özet
Sovyetler Birliği’nin yıkılmasını takiben, uluslararası hukuk alanında doğan boşluk, uluslararası hukuk kuramının ‘şans keşifleri’ ile doldurulmaya başlanmıştır. Bu bağlamda uluslararası hukukta üç ana söylemsel hat tespit edilebilmektedir. Söz konusu söylemsel hatlar Sovyetler Birliği’nin yıkılmasının ardından yeni duruma uygun bir üretim süreci içinde tekrar çalıştırılmaya başlanmıştır. Bu söylem hatları, anılan yeni durum içerisinde belirli sınıfsal içerikler edinmektedirler. Uluslararası hukuka ilişkin düşünce de söylemlerin içinden anılan sınıfsal içerikle donatılarak çıkmaktadır. Burjuva-kozmopolitan, devletçi ve ülkesel söylem olarak tarif edilebilecek olan bu ana hatların işlevi ise Sovyet sonrası dönemin, özgün ekonomik-politik koşullarında belirlenmektedir. Bu bağlamda da bir hukuk söyleminin anlaşılması onun söylem dışına yani kurduğu nesnel ilişkilere gitmeyi zorunlu kılmaktadır.
