REDESIGNING THE PUBLIC SUPERVISION INSTITUTION (THE OMBUDSMAN INSTITUTION OF TURKEY)

Abstract

The Public Supervision Institution, which is a constitutional insti- tution in Turkey, constitutes the equivalent of “ombudsmania” movement in the world. A system of supervision, which is so common in the world, has been organized by nation-states and supranational instituti- ons such as the European Union with different characteristics. The om- budsman system in our country should also be shaped according to the legal system and administrative structure of our country. When the five- year activity is examined, it is seen that the Public Supervision Institu- tion is not effective compared to its successful examples in the world. Therefore, it is inevitable to redesign the legal structure of the Public Supervision Institution. In this context, various determinations and sug- gestions for revising the Institution in terms of both organic and functio- nal aspects have been tried to be introduced.

Özet

Türkiye’de anayasal bir kurum olan Kamu Denetçiliği Kurumu, dünyadaki “ombudsmanya” (“ombudsmania”) akımının ülkemizdeki karşılığını oluşturmaktadır. Dünyada bu kadar çok yaygın olan bir dene- tim sistemi, ulus devletler ve Avrupa Birliği gibi ulus üstü kurumlarca farklı özelliklere sahip olarak düzenlenmiştir. Ülkemizdeki ombudsman- lık denetimi de yine ülkemizin hukuk sistemine ve idari yapısına göre şekillendirilmelidir. Yaklaşık beş yıllık faaliyetine bakıldığında, Kamu Denetçiliği Kurumunun dünyadaki başarılı örneklerine nazaran etkin olmadığı görülmektedir. Bu nedenle Kamu Denetçiliği Kurumuna ilişkin hukuki yapının yeniden tasarlanması kaçınılmazdır. Bu kapsamda Ku- rumun gerek organik anlamda gerekse fonksiyonel anlamda yeniden gözden geçirilmesine yönelik çeşitli tespitler ve öneriler getirilmeye ça- lışılmıştır.
