Crimes of Civil Servants in the Ottoman Countryside (Case of Safranbolu in 19th and 20th Centuries)

Abstract
The civil servants are less well-known with crimes and criminals because of their service to the state. However, it is also possible for the civil servant to exploit the duties, rights and powers held by him and to commit a crime by making use of them. In every period of history, as a state official, different practices have emerged regarding the crimes committed by civil servants. In the Ottoman Empire, the crimes committed by the people who served in the state service were subject to different legal practices according to the period. However, more legal and democratic behaviors have emerged in the prosecution of civil servants for crimes committed in direct proportion to the impact and prevalence of concepts such as individual rights and freedoms and human rights. In this study, the types of crimes committed by civil servants in the 19th and 20th century Ottoman Empire, the reasons of crime, their effects on public order and social life, and the attitude of the administration against the crimes of civil servants were handled from the example of Safranbolu, an Ottoman country.
Özet
Devlet memuru görevi gereği devlet hizmetinde bulunan, bu yönüyle suç ve suçluyla daha az anılan bir kesimdir. Bununla birlikte devlet memurunun, elinde bulundurduğu görev, hak ve yetkileri istismar etmesi ve bunlardan yararlanarak suç işlemesi de mümkündür. Tarihin her döneminde bir devlet görevlisi olarak memurların işledikleri suçlar konusunda farklı uygulamalar ortaya çıkmıştır. Osmanlı Devleti’nde de devlet hizmetinde bulunan kişilerin işledikleri suçlar, dönemine göre farklı hukuki uygulamalara tabi tutulmuştur. Ancak bireysel hak ve özgürlükler ve insan hakları gibi kavramların etki ve yaygınlığı ile doğru orantılı olarak devlet memurlarının işledikleri suçlardan dolayı yargılanmalarında daha hukuki ve demokratik davranışlar ortaya çıkmıştır. Çalışmada XIX. ve XX. yüzyıl Osmanlı Devleti’nde devlet memurları tarafından işlenen suçların türleri, suç sebepleri, kamu düzenine ve sosyal hayata etkileri ve memur suçlarına karşı idarenin tavrı bir Osmanlı taşrası olan Safranbolu örneğinden hareketle ele alınmıştır.
