(ON THE CONSTITUTIONALITY OF THE IMPEDIMENTS TO ADMISSION INTO ATTORNEYSHIP AND THE AUTHORITY OF SUSPENSION OF ADMISSION PROCESS)

Abstract
The profession of attorneyship has different principles and values due to its functions in the realization of human rights and especially the right to a fair trial. According to the Article 5 of the Attorneyship Act, the imprisonment for certain offenses or imprisonment for a certain period is an impediment to admission into attorneyship, and Article 72 of the same Law stipulates that if a lawyer has a final conviction for the crimes specified in the Article, he/she shall be excluded from the Bar. This criterion is unconstitutional in terms of proportionality and principles of rule of law. On the other hand, the provision regulating that the admission process can be suspended if the lawyer candidates are under prosecution for these offenses, is contrary to the presumption of innocence and violating the right to work in an unconstitutional way.
Özet
Avukatlık mesleği, insan hakları ve özellikle adil yargılanma hakkının gerçekleşmesi konusundaki işlevleri nedeniyle farklı niteliklere, ilke ve değerlere sahiptir. Avukatlık Kanunu’nun 5. maddesinde belli suçlardan veya belli süreyle hapis cezasına mahkûm olmak avukatlığa girişe engel olarak düzenlenmiş ve aynı Kanun’un 72. maddesinde bir avukatın maddede belirtilen suçlardan kesinleşmiş mahkûmiyeti olması durumunda baro levhasından silineceği düzenlenmiştir. Sayılan suçlar ve iki yıldan fazla hapis cezasına mahkûm olmak şeklinde belirtilen bu ölçütte ölçülülük ve hukuk devleti ilkeleri açısından anayasaya aykırılıklar bulunmaktadır. Diğer yandan, avukat adaylarının bu suçlardan kovuşturma altında olması durumunda kabul işleminin askıya alınabileceğine ilişkin hüküm masumiyet karinesine aykırıdır ve çalışma hakkını anayasaya aykırı biçimde sınırlandıran bir hükümdür.
