The Enactment Process of the 1921 Constitution in the Context of the Negotiation and Legislative Methods

Abstract

The democratic character of the preparation processes of the Turkish constitutional texts is often been the subject of serious criticism and discussion. The 1921 differs from the other Turkish constitutions in terms of both the legislative method and the democratic character of the negotiation process. In this study, the democratic character of the preparation processes of the 1921 Constitution is tried to be revealed by analyzing the negotiation and legislative method of the constitution in the framework of procedures and provisions of the internal regulation. Then, the points which the Grand National Assembly distinguishes itself from the former periods by defining itself as a ‘constituent assembly’, are stated. And finally, it should be noted that the 1921 Constitution continued the Ottoman tradition in connection with parliamentary continuity and internal regulations.

Özet

Türk anayasa metinlerinin hazırlanış süreçlerinin demokratikliği genellikle ciddi eleştiri ve tartışmalara konu olmaktadır. 1921 Anayasası, diğer Türk anayasa metinlerinden hem yasama yöntemi ve hem de görüşme sürecinin demokratikliği açısından ayrılmaktadır. Bu çalışmada 1921 Anayasasının görüşme ve yasama yöntemi, uygulanan usuller ve özellikle de içtüzük hükümleri çerçevesinde incelenerek Anayasa’nın hazırlanış sürecinin demokratikliği ortaya konulmaya çalışılmıştır. Bunun ardından ise; Büyük Millet Meclisi’nin kendisini ‘kurucu meclis’ olarak tanımlayarak ayrıştığı noktalar belirtildikten sonra; 1921 Anayasası’nın parlamenter devamlılık ve iç tüzük bağlanımda Osmanlı geleneğini sürdürdüğüne dikkat çekilmektedir
