An Assessment about Murdering Events and Murdering lnvestigations in Mardin during the Ottoman Period

Osmanlı Mardin'inde Cinayet Vakaları ve Cinayet Soruşturmaları Hakkında Bir Değerlendirme

Abstract

The final point of the violence emotion that people shelter inside is killing another person. According to the belief, Habil, one of Adam's sons killed his other son Kabil, and,this is the first example of this matter. So, it can be said that this matter is contemporary with the adventure of the people in the world. In eveıy time of the world people killed each other because of a reason or various reasons and they didn't consider the differences such as race, age, sex, religion, or sectarian while doing that. The feeling of law that has come into existence as a result of the desire to solve the conflicts between people has been closely interested in it. The subject of this study is the murder cases that have been investigated in Mardin Qadı Court during Ottoman period. It is stated how the Ottoman qadı registers consider to this event, the profiles of the murderers and the people who were murdered, the scene of the murders, the murder tools and the reasons why people face this event. We tried to emphasize what the differences and similarities between the murder cases in the past and today are.

Özet

İnsanların içlerinde barındırdıkları şiddet duygusunun en son noktası bir diğer insanın yaşamına son vermesidir. İnanışa göre Hz. Ademin oğullarından Kabil'in Habil'i öldürmesi ile ilk örneğine rastlanılan bu insanın yeryüzündeki serüveni ile yaşıttır denilebilir. Zamanın tüm olgu evrelerinde insanlar neden ya da nedenlerle karşılarındakilerin yaşamlarına son vermişler ve bunu yaparken de ırk, yaş, cinsiyet, din, mezhep ve benzeri farkları göz önünde bulundurmamışlardır. İnsanlar arasındaki anlaşmazlıkların çözümü arzusundan ortaya çıkmış olan hukuk duygusu ise bu tür durumlarla yakından ilgilenmiştir. Bu çalışmada Osmanlı Dönemi Mardin'inde Kadı mahkemesine yansımış olan cinayet davaları konu edinilmiştir. Osmanlı kadı sicillerinin bu olaya nasıl yaklaştığı, cinayeti işleyen ve cinayete kurban gidenlerin profilleri, cinayet işlenen mekanlar, cinayet aletleri ve insanları bu duruma sürükleyen nedenler üzerinde durulmuştur. Geçmişte yaşanmış cinayet olayları ile bugün yaşananlar arasında ne tür benzerlikler ve farklılıklar olduğu ortaya koyulmaya çalışılmıştır.
