ADMINISTRATION OF MOSQUES AND MOSQUE SERVICE STAFF BY GENERAL DIRECTORATE OF FOUNDATIONS (1931-1950)

Abstract
The administrative authority for all mosques, masjids, as well as relevant service staff in Turkey was given to the Presidency of Religious Affairs, pursuant to Article 5 of the Law No. 429 dated 3 March 1924. However, pursuant to an article in the budgetary law in 1931 enforced the transfer of all administrative authority over mosques, masjids, and relevant service staff to the General Directorate of Foundations. The transfer of the authority over mosques and relevant service staff to the Presidency of Religious Affairs could only be possible through an additional law on the presidency on 23 March 1950. According to this, approximately for 20 years, instead of the Presidency as the primary authority, the administration of mosques and people in service of mosques was vested in the General Directorate of Foundations, thus causing double authority in religious services and a number of problems along the way. In this study, with regard to the years in which the mosques and offi cial employees of the mosques were under authority of the General Directorate of Foundations, the services of the mosques and problems experienced are examined.

3 Mart 1924 tarih ve 429 sayılı kanunun 5. maddesi ile Türkiye’deki bütün cami ve mescidlerle cami görevlilerinin idaresi Diyanet İşleri Reisliğine verilmiştir. Ancak, 1931 yılında bir bütçe kanun maddesiyle cami ve mescidlerle cami görevlilerine ilişkin idari yetkiler Evkaf Umum Müdürlüğü’ne devredildi. Camilerin ve cami görevlilerinin Diyanet İşleri Başkanlığı’na iadesi, ancak 23 Mart 1950’de Başkanlık’la ilgili olarak çıkarılan ek bir kanunla mümkün oldu. Buna göre, yaklaşık 20 yıl boyunca, Diyanet İşleri Reisliği gibi aslî mercii dururken, camiler ve cami hizmetlilerinin idaresinin, o günkü adıyla Evkaf Umum Müdürlüğü’nde kalması, din hizmetlerinin yerine getirilmesinde iki başlılığın yaşanmasına sebep olmuş, bu durum, birtakım olumsuzluklar doğurmuştur. Bu makalede, camilerin ve cami görevlilerinin Evkaf Umum Müdürlüğü’nde olduğu yıllarda, ülkemizde din hizmetlilerinin idaresi, cami hizmetlerinin aldığı veçhe ve bu çerçevede yaşanan sıkıntıların bir kısmına temas edilmektedir.
