Ismāil b. Sinān al-Sivāsī and Hıs Work Named Ferāid al-Mülteka al-Ebhur

Abstract

Ismāīl b. Sinān (d. 1048/1638) was a scholar who served as a professor (mudarris) in Istanbul and a mufti in Sivas. He wrote a commentary titled Farāid on Multaqā. The author began writing this commentary in 1031/1622 and completed it in 1035/1625. Farāid explains the phrases and rarely used words found in Multaqā and also provides the evidence for the legal preferences of Ḥalabī (d. 956/1549). Additionally, Ismāīl b. Sinān occasionally made his own legal preferences and sometimes critiqued the main text of Multaqā. He tackled contemporary legal issues of his time by utilizing the accumulated knowledge of classical Islamic jurisprudence. Farāid was also taken into account by significant jurisprudential works that came after it. One of its most notable features is the author’s ability to compose explanations of certain phrases or rulings by skillfully combining passages from multiple sources. Because of these characteristics, Farāid, being a comprehensive commentary, can be considered one of the significant commentaries on Multaqā. This article aims to discuss the life and works of Ismāīl b. Sinān, examining the authorship, chronology, purpose of writing, content, importance, method and structure of Farāʾidu al-Multaqā al-Abḥur, its place in the jurisprudential literature, the sources used within it, and the references made to Farāid in later works.

İsmâil b. Sinân (ö. 1048/1638) İstanbul’da müderrislik ve Sivas’ta müftülük yapmış, Mültekâ’ya Ferâid isminde şerh yazmış bir âlimdir. Müellif bu şerhi 1031/1622 yılında yazmaya başlamış 1035/1625 yılında tamamlamıştır. Ferâid, Mültekâ’nın ibarelerini ve kullanımı yaygın olmayan kelimelerini açıklamakla birlikte Halebî’nin (ö. 956/1549) tercihlerinin delillerini de açıklamıştır. Bununla birlikte bazen kendisi tercihte bulunmuş bazen de Mültekâ’nın metnini eleştirmiştir. Kendi döneminin güncel fıkhî problemlerini klasik fıkıh birikiminden faydalanarak çözmüştür. Ferâid kendisinden sonraki dönemde önemli bazı fıkıh eserleri tarafından da dikkate alınmıştır. Ferâid’in bir diğer önemli yönü ise, bir ibarenin ya da hükmün açıklanması için birkaç eserden aldığı pasajları kompoze etme başarısıdır. Bu özellikleri sebebiyle, hacimli bir şerh olan Ferâid’in, Mültekâ’nın önemli şerhlerinden biri olduğu söylenebilir. Bu makalede İsmâil b. Sinân’ın hayatı ve eserlerinden bahsedilip, Ferâidu Mülteka’l-ebhur’un müellife aidiyeti, yazılış sırası ve tarihi, yazılış nedeni, muhtevası, önemi, konuların işleniş tarzı ve sistematiği, fıkıh literatüründeki yeri, Ferâid’de kendisinden istifade edilen kaynaklarla Ferâid’den sonraki kitaplarda Ferâid’e yapılan atıflar tespit edilerek incelenmeye çalışılmıştır.
