A Polymath Jurist of 16th-Century Ottoman Hanafism: Ibn Hammada al-Antaki

Abstract

This study explores the life and scholarly character of Ibn Ḥammāda al-Anṭākī, one of the prominent jurists of the 16th-century Ottoman-Hanafi intellectual tradition. Having pursued his education -which began in Antioch- across major scholarly centers such as Aleppo, Mecca, and Cairo, al-Anṭākī was a jurist who synthesized rational sciences, such as logic, theology, and legal theory, with traditional sciences, such as hadith and recitation. His receipt of hadith licenses from leading authorities like Shihāb al-Dīn al-Qasṭallānī (d. 923/1517) and Zakariyyā al-Anṣārī (d. 926/1520) demonstrates that he anchored his juridical faculties in a robust foundation of transmission. The most distinguishing feature of Ibn Ḥammāda al-Anṭākī is his integration of theoretical jurisprudence with bureaucratic and practical legal experience. By practicing the professions of tevkî‘ and shahāda, which he inherited as a family tradition, he transcended the role of a mere mudarris to become a legal technician proficient in the science of shurūt and the methods of drafting diplomatic documents. Furthermore, his principled stance against sectarian restrictions-notably evidenced by his refusal of a position at the Aleppo Sultaniye Madrasa due to the inscription the mudarris must be of the Shafi'i madhhab -along with his use of a flexible Turkish-Arabic linguistic approach in public guidance activities, reveals his significant role in the socialization of jurisprudence. Within the scope of this paper, al-Anṭākī’s meticulous marginalia works, his treatise on the rituals of Hajj, and his contributions to Ottoman-Hanafi legal thought will be analyzed in light of the testimonies of his contemporaries, such as Raḍī al-Dīn Ibn al-Ḥanbalī (d. 971/1563).

Bu çalışma, 16. yüzyıl Osmanlı- Hanefî ilim geleneğinin önemli fakihlerinden biri olan İbn Hammâde el-Antâkî’nin hayatı yanında ilmî karakterini konu edinmektedir. Antakya’da başladığı eğitim hayatını Halep, Mekke ve Kahire gibi ilim merkezlerinde devam ettiren İbn Hammâde el-Antâkî mantık, kelam ve fıkıh usulü gibi aklî ilimlerle, hadis ve kıraat gibi naklî ilimleri şahsında birleştiren bir fakihtir. Özellikle Şihâbüddîn el-Kastallânî (ö. 923/1517) ve Zekeriyyâ el-Ensârî (ö. 926/1520) gibi otoritelerden hadis icazeti alması, onun fıkhî melekelerini güçlü bir rivayet temeline oturttuğunu göstermektedir. İbn Hammâde el-Antâkî’nin temâyüz eden en mühim yönü, nazarî fıkıh birikimini bürokratik ve amelî hukuk deneyimiyle mezcetmiş olmasıdır. Aile geleneği olarak tevarüs ettiği tevkî‘ ve şehâdet mesleklerini icra etmesi, onu sadece bir müderris değil, aynı zamanda şürût ilmi ve diplomatik belge düzenleme usullerine hâkim bir hukuk teknisyeni konumuna taşımıştır. Ayrıca, Halep Sultaniye Medresesi’nin kapısındaki 'müderris Şâfiî mezhebinden olmalı' yazı sebebiyle mezhebî sınırlamalara karşı sergilediği ilkeli duruş ve halka yönelik irşat faaliyetlerinde kullandığı Türkçe-Arapça esnek dil, fıkhın toplumsallaşma sürecindeki rolünü ortaya koymaktadır. Tebliğ kapsamında, Radıyyüddîn İbnü’l-Hanbelî (ö. 971/1563) gibi muasırlarının tanıklıkları ışığında İbn Hammâde el-Antâkî’nin hassas tahşiye çalışmaları, hac ve umre menâsikine dair telifi ve Osmanlı-Hanefî hukuk düşüncesine katkıları tahlil edilecektir.
