Abstract

Nowadays, in terms of the “existence of women”, although there is the fact that legal arrangements have been made to get rid of the patriarchal cycle in the field of Turkish family law and there are decisions taken by the Constitutional Court; it would be appropriate to say that women are constantly struggling for existence in the family and society in the current order. Although it is said that the first thing to be created in order to eliminate the inequality between women and men is social awareness, it is necessary to take steps to ensure that these legal regulations are actually put into practice with the social awareness to be created, rather than just including the legal regulations for women in written texts. In our opinion, the necessity of creating a preventive public intervention against this political situation will have taken an important step by getting rid of the thought that the violence to which the woman who is imprisoned in the relationship of home and marriage, which is accepted as “private”, will be experienced “in private”. The text of the study covers the concept of feminism, which was founded in the 1700s and on the rise in the 1980s; aims to explain women and women's rights within the “patriarchal” Turkish family law system, which aims to eliminate the sexist structure and exploitation today, in the light of legislative changes and developments in the Constitutional Court's case-law, and on the basis of the understanding of “the personal is political”.
