Abstract

ECHR considers the phase of appeal in the scope of Article 5(1)(a) of the convention, in other words as conviction. However, in Turkish law, during the appeal, the accused arrested cannot be regarded as a convict. In this manner, the meanings attributed to “conviction” by ECHR and Criminal Procedure Code do not overlap. On the other hand, ECHR keeps count of being arrested during appeal in manners of both determining “whether legal grounds for giving a decision not to release or to re-detain exist” and “whether the principle of trial within a reasonable time” is violated or not. Excluding the time spent during appeal when estimating the upper time limits for arrest is obviously contrary to law

Özet

AİHM temyiz aşamasını, AİHS m. 5(1)(a) kapsamında yani hükümlülük olarak değerlendirmektedir.
