Abstract

Extradition, which may define as one person who stands in any country, in the case of being suspected or offender for an offence which committed in another country, in order to make investigation and proceedings or enforcement of penalty, surrender another country on the request which made by related country, more and more coming on both state and world’s public opinions’ agenda. Regarding extradition law, as well as necessary conditions to realize the extradition and also precluding situations have importance. One of them is the citizenship. While citizenship precludes the extradition, related TPC provision and the legal situation of persons who have lost citizenship with leaving documents are having some problems. In this framework, Article 18 of Turkish Penal Code and Article 28 of Turkish Citizensip Act are being examined.
