Özet
Bir insan hakkı ihlali olarak toplumsal cinsiyete dayalı şiddetle mücadelede hukuk normları ve bu normların nasıl uygulandığı önem arz etmektedir. Yargı- nın ev-içi şiddete ilişkin davalarda normları yorumlarken ataerkil ön anlayıştan hareket etmesi yargının tarafsızlığı ilkesini ihlal etmektedir. Bu çalışmada Türkiye Cumhuriyeti devleti mahkemelerinde verilmiş bazı karar örnekleri üzerinden nötr görünümdeki ataerkil tarafgirliğin eleştirisi yapılacaktır.
