Abstract

In cases where an act of tort also amounts to the breach of another pre-existing legal relationship between the same parties, referral to the mechanism of accessory connection and connecting the relevant tortious relationship to the law applicable for that other relationship can be seen as a useful device. The primary goal of his method is to prevent particular problems that may arise in the domain of competition of claims and characterization with relation to the dispute in question. Modern confl icts rules on tort often include this method, either by embracing a special connecting factor or by way of exemplifying certain relationships under the exception rule, which enables the application of the law of a state which is more closely connected with the tort. This paper intends to shed light on the purpose, compulsory elements and certain variations of this method as seen in modern confl icts rules. With that in mind, after examining the relevant Swiss, EU and Japanese norms from certain aspects, and also providing some examples regarding the usage of this method, current framework of the Turkish Act on Private International and Procedural Law will be introduced. Finally, our conclusions about that framework alongside with our suggestions will be presented.

Özet

Bir haksız fi ilin aynı tarafl ar arasında hâlihazırda mevcut bir başka hukukî ilişkiden doğan yükümlülüğü de ihlâl sonucunu doğurduğu hâllerde, fer’i bağlanma olarak adlandırılan bir yöntemden faydalanılarak, haksız fi il statüsünün söz konusu o diğer hukukî ilişkiyi idare eden hukuka bağlanması, böylelikle talep haklarının yarışması ve farklı vasıfl andırma ihtimalleri üzerinden gündeme gelebilecek birtakım sorunların engellenmesi mümkündür. Haksız fi illere uygulanacak hukukun tespitine ilişkin çağdaş düzenlemeler, fer’i bağlanma yöntemini genellikle örneklemeler üzerinden açık şekilde hükme bağlamaktadırlar.
