Abstract

The mobbing and bullying phenomena were first isolated and identified in 1984 by Swedish industrial psychologist Dr. Heinz Leymann, who was primarily concerned with the impact of mobbing on the target in terms of medical stress. He defines mobbing as “hostile and unethical communication, which is directed in a systematic way by one or a few individuals mainly towards one individual who, due to mobbing, is pushed into a helpless and defenseless position, being held there by means of continuing activities”. There is extensive literature regarding this phenomenon especially in countries such as Sweden, Germany, France and Norway. Awareness is rapidly growing in the Europe and the U.S about the darker side of work and destructive effects that mobbing or psychological terror can have on the self, health, organizations and society. Although the study of psychological side of mobbing and bullying attracted noticeable attention recently in Turkey, there has been paid a little attention to the analysis of economical and legal aspect of this issue. In this paper, we try to attempt to evaluate the legal consequences of mobbing and bullying in the Turkish workplace, and then some recommendations are made for taking actions against bullying.
