Abstract
The role of artificial intelligence in creative processes necessitates a reconsideration of fundamental concepts within intellectual property law. Whether AI-generated outputs qualify as works, and who should be recognized as their rights holder, exposes the insufficiency of traditional criteria of authorship-creativity, individuality, and intellectual effort. Considering that the aim of intellectual property law is not only to safeguard authors’ rights but also to encourage creative activities for the benefit of society, works produced by AI should also enjoy certain protections. Accordingly, new legal frameworks governing the rotection, transfer, and use of such rights are required. These regulations must clarify both the legal status to be accorded to AI and the ownership of outputs created thereby. At the international level, harmonized rules are crucial; presumptions of authorship should extend to programmers, investors, and other contributors. As illustrated by Section 9(3) of the UK Copyright, Designs and Patents Act, recognizing the person who makes the necessary arrangements as the author offers a functional model. Ultimately, the modernization of Turkish copyright law (FSEK), the introduction of an AI-specific notion of works, and the establishment of sui generis protection regimes are indispensable for the adaptation of the legal system to technological transformation.
