Abstract

Some Notes on Ottoman Law Order and Ebussuud Efendi’s Juridical Views Concerning Cash Waqfs in Ottoman Empire This study examines the Ottoman law order and Ebussuud Efendi’s juridical views about the cash waqfs in Ottoman empire. Firstly it deals with the relation between Qânûn law and Sharî’a law in the Ottoman law order. Then it analyses Ebussuud Efendi’s juridical views concerning the disputes on the cash waqfs. Finally it makes an evaluation about the subject

Özet

Bu çalışma, Osmanlı hukuk düzenini ve Ebussuud Efendi’nin Osmanlı İmparatorluğunda nakit vakıflar. İlk önce Qânûn yasası ile ilişki arasındaki ilişkiyi ele alıyor.Osmanlı hukuk düzeninde Sharîa hukuku. Daha sonra Ebussuud Efendi’nin hukuki görüşlerini analiz eder. Nakit vakıflar üzerindeki ihtilaflarla ilgili olarak. Sonunda konu hakkında bir değerlendirme yapar.
