Abstract
In Türkiye, urban transformation practices have accelerated markedly following the entry into force of Law No. 6306 on the Transformation of Areas Under Disaster Risk in 2012, becoming one of the central pillars of contemporary urban policy. While this process is grounded, on the one hand, in legitimate and compelling public interests—such as reducing disaster risks, particularly earthquakes, ensuring the protection of life and property, and promoting safe and sustainable urban development—it has, on the other hand, entailed intensive, far-reaching, and often coercive interferences with the right to property. Risky building determinations, demolition and evacuation orders that may be adopted without the explicit consent of property owners, urgent expropriation measures, and restrictions imposed on the use of property have given rise to serious constitutional debates regarding the scope and content of the guarantees afforded to the right to property under Article 35 of the Constitution. This study examines the impact of urban transformation practices on the right to property in the light of the individual application judgments of the Constitutional Court. In particular, it analyses how the Court has interpreted and applied the principles of legality, foreseeability, proportionality, fair balance, and the right to an effective remedy in concrete cases. The study seeks to delineate the boundaries of the constitutional balance struck by the Constitutional Court between the requirements of the public interest and the protection of individual property rights in the context of urban transformation, and to assess, from a critical perspective, the direction and evolution of the Court’s jurisprudence over time.
