Nevevî’nin “El-Usûl ve’d-Davâbıt” Adlı Eseri: Tercüme ve Tahlîl

Özet

Kırk beş sene gibi kısa bir ömre nice başarıları sığdırmış yetkin bir ilim adamı olan Nevevî, telifleri ve yetiştirdiği talebelerle sadece fıkıh alanında değil İslami ilimlerin diğer alanlarında da adından söz ettirmiştir. Telifleri, tahkikleri ve görüşleri, sonraki âlimler tarafından mutemet kabul edilmiştir. İlim dünyasında görüşlerine değer verilen Nevevî, hadis, fıkıh, usûl, dil, tabakât, terâcim ve diğer alanlara dair elliye yakın eser yazmıştır. Şâfiî mezhebinin önemli temsilcilerinden biri olup, özelde bu mezheple ilgilenmiş olsa da ortaya koyduğu eserlerle İslam hukuku genelinde önemli bir konum elde etmiştir. Tercüme ve değerlendirmesini yaptığımız el-Usûl ve’d-davâbit adlı eseri araştırdığımız kadarıyla Türkiye’de hakkında herhangi bir çalışma yapılmamıştır. Mezkur eser, isminden de anlaşılacağı üzere usûl ve kavâid ile ilgili önemli bir eserdir. Nevevî bu eserinde, ilim talebesi için önem arz eden fıkhî kaideler ile usûl ve makâsıda dair dokuz mesele zikretmekte ve bu meselelere dayanan fürû-i fıkhın hükümlerini açıklamaktadır. Nevevî’nin bu eseri kaleme almasının amacı, fıkhî kaidelere dair bir eser telif etmek değil, ilim talebelerinin ihtiyaç duyacağı bazı kaide ve kuralları zikretmektir. Bu çalışmada Nevevî’nin söz konusu eseri tercüme edilmiş, metinde geçen kavramlar tanıtılmış, kapalı ve anlaşılmayan konular vuzuha kavuşturulmuştur. Ayrıca ihtiva ettiği konular üzerinde ilmî bir değerlendirme yapılmıştır.

Abstract

Nawawî, who is a competent scholar achieving many successes in a short life span of forty-five years, has made a name for himself not only in the field of Islamic law (fiqh), but also in the area of other Islamic sciences. His works, investigations and opinions have been fiducially accepted by later scholars. Nawawî, who is his views are appreciated in the Islamic world, wrote nearly fifty works on hadith, fiqh, methodology (usûl), language, biography (tabaqât), and other fields. Nawawî, who is one of the important representatives of the Shafi'i sect, has gained an important position in Islamic law with his works, although he was particularly interested in this sect. The work called “al-Usûl wa ad-Dawâbit”, which we have translated and evaluated, is about usûl and qawâid, as you can understand from it’s name. In this work, Nawawî mentioned nine issues related to fiqh rules, method and point, which are important for the student of science, and explained the rules of fiqh based on these problems. The purpose of Nawawî's writing this work is not to compose a work on fiqh’s rules, all science students will need. In this study, Nawawî's aforementioned article has been translated, the concepts in the text have been introduced, and the sealed and incomprehensible issues have been clarified. In addition, a scientific evaluation has been done on the subjects it contains.
