Özet
Bu makale, Türkiye Katılım Bankaları Birliği Danışma Kurulu tarafından yayınlanan Kefalet Standardı ile ilgili yapılan ilk çalışmadır. Araştırma, Kefalet Standardının kapsamına aldığı hususları eleştirel ve analitik bir yöntemle incelemekle birlikte bu husustaki tartışmalara da değinmekte ve sonuç olarak tercih edilen görüşü sunmaktadır. Araştırmada, borca kefalet ile ilgili olmasına rağmen standardın değinmediği konulardan da bahsedilmektedir. Araştırmacı, standardın modern çağ ile uyumlu birkaç olumlu sayılabilecek yönlerini tespit etmiştir. Bu yönlerden birisi, kefaletin ileri bir tarihe veya bir şarta bağlanmasına cevaz verilmesidir. Ancak standardın bazı noktaları da itiraz konusu olabilmektedir. Nitekim standardın kapsamının, borca kefalet hükümleri ile sınırlı olmasına rağmen başlığının genel olması ve yine kefalet ile emanet akitlerinin tek bir akitte birleştirilmesi gibi açıklığa kavuşturulması ve detaylandırılması gereken bazı meselelerin ihmal edilmesi standardın eleştirilebilecek bazı yönleridir
Abstract
This research is the first study dealing with the Suretyship (Kafalah) standard issued by the Shariah Board of the Union of Turkish Participatory Banks. The research aims to conduct a critical analytical study of the aspects and points dealt with in the standard in order to know the controversy around them. The research also works on addressing issues that were not addressed by the standard. In this research, it became clear to me that among the positive aspects of the standard he mentioned are many provisions and matters that are in line with the spirit of the modern time. Such as the permissibility of the timing and suspension of the Kafalah. However, the one who notes on the standard some points. Including: the fact that its title is general despite its being limited to the provisions of guaranteeing the debt, and its omission of some issues that needed to be explained and detailed
