Özet
İnsanoğlu toplum içerisinde yaşamaya başladığı andan itibaren güven içindeyaşayacağı ve hem kendisinin hem diğer insanların haklarını koruyacağı toplumsaldüzen için belli kurallar belirlemiştir. Bu toplum düzeni, birlikte yaşamazorunluluğundaki insanların davranışlarına yön verir. Belirlenen kurallar ise özgüryaşamanın teminatıdır.Toplumsal değerlerin kaynağını oluşturan dinî ve toplumsal değerler aile ve çevre ilenesillere aktarılır. Ancak daha açık ve net kurallara ihtiyaç duyan insanlar, bir yandanyazılı ve bağlayıcı hukuk kurallarını üretirken; diğer yandan düşünürler farklı inanışve kültürlere sahip toplulukların ortaya çıkışından dolayı tüm zaman ve mekânlar içingeçerli olacak bir ahlakî ilkeye veya ilkelere göre yaşamayı salık vermişlerdir. Zirahukuk kuralı devlet gücüyle yaptırıma bağlanmışken, ahlak, din ve görgü kurallarınınyaptırımları bireysel ve vicdanî kabul ve tercihlere dayanmaktadır. O nedenle “öyledavran ki…” ifadesi ahlakî ve felsefî zeminde yer edinmiştir.
Abstract
From the moment people begin to live in society, they set certain rules for the socialorder in which they will live in confidence and protect the rights of both themselvesand others. This social order guides the behavior of people who are obliged to livetogether. The specified rules are a guarantee of free living.The religious and social values that constitute the source of social values aretransferred via family to the generations. However, people who need more clear andclear rules, while producing written and binding rules of law, on the other hand,thinkers have recommended to live according to a moral principle or principle whichwill be valid for all times and places due to the emergence of communities withdifferent beliefs and cultures. For while the rule of law is dictated by state power,sanctions of moral, religious and etiquette are based on individual and personalconviction and preferences. For that reason, "act in such a way that ..." has gained aplace in the moral and philosophical grounds.
