Özet

Allah Teâlâ ‘eşrefi mahlûk’ olarak yarattığı insana, güzelle çirkini,iyiyle kötüyü ayırt etme kabiliyeti vermiştir. Bu yüzden insanlardadiğer hiçbir mahlûkatta olmayan din ve ahlak sahibi olmaözelliği vardır.Allah’ın insanlara ilk yaratılıştan beri kötü olarak gösterdiği fiillerdenbiri de zinadır. Bunun için İslamiyet’te zina titizlikle elealınmış ve onun için önleyici ve engelleyici çok sağlam tedbirlergetirmiştir. Evli veya bekâr ayrımı yapmadan, kasıtlı ve nikâhsızolarak yapılan her cinsi ilişkiyi gayr-i meşru ve haram saymıştır.Bundan başka insan tabiatına ters, tiksindirici olan lûtîliğin herçeşidi, ölülerle, hayvanlarla cinsel ilişki, müsahaka ve istimnanınharam kılınması; cinsi ihtiyaçların tabii ve meşru çerçevedekarşılanması, fıtrat ve iffetin korunması, insanlık onurunu zedeleyenher türlü cinsî azgınlık ve sapıklıktan uzak durulmasınınKur’an’ın temel mesajlarından biri olduğu görülür. Çünkü zinaİslam’a göre fert, aile ve toplumu yıkmayı hedef alan büyük birfelaket, bir insanlık suçudur.Hadislerde geçen gözün ve dilin zinası tabirleri ile harama bakmanınve yaygın ahlâk kurallarına uymayan cinsel içerikli sözler söylemeklebaşlayan sürecin zinaya götürme ihtimalinin yüksekliğiniifade eder ve bunlardan sakındırır.Fıkıhta zina suçunun oluşması ve cezalandırılması yanında zinanınönünün kesilmesine yönelik tedbirlerin alınması sayesindeİslâm tarihi boyunca Müslüman toplumlarda zina hem yasakhem de günah ve ayıp sayıldığı için yaygın bir ahlâk sorunu oluşturmamıştır.Araştırmamızda, cinsiyet siyasetinin bir politika olarak ele alındığı,zina ve çeşitlerinin ‘cinsel özgürlük’ kavramı altında normal birilişki gibi kabul edildiği ve günümüzde neredeyse bir baskı aracıhaline getirildiği Batı dünyasında,1 zina fiilinin önlenmesine dairçalışmalar yerine 1980’lerden bu yana, bu ilişkilerden dünyayagelen çocuklar ve bunların ana-babalarına dair düzenlemeye gidilerek,devletlerin Tek Ebeveynli Aile adı verilen oluşumlara destekverdikleri görülmektedir. 2000’li yıllarda ise bu destek lûtîler içinverilmektedir. Bazı Batılı ülkelerin istatistiklerinden elde edilenverilerine göre toplumda zina giderek yaygınlaşmakta, bu yolladünyaya gelen çocuk sayısı her geçen yıl artmakta ve eşcinsellikdüzenlemesi yapılması normal karşılanmaktadır.TU İK istatistiklerinde son yıllarda daha çok boşanma sebebiyleortaya çıktığı gözlemlenen Tek Ebeveynli Aile oluşumunun, Aile,Çalışma ve Sosyal Hizmetler bakanlığının yaptığı çalışmalarda, gayri meşru ilişkilerle alakasının kabul edildiği ve bu aile tipinedestek verildiği görülmektedir.2Bu makalede 21. yüzyılda Batı’da zina fiilini meşrulaştıran bazıaile düzenlemeleri üzerinde durulacaktır. Konu ele alınırken insanınAllah tarafından ‘eşrefi mahlûk’ olarak yaratılması ve HadidSuresi 16. ayette ifade edilen mana göz önünde bulundurulacaktır.

Abstract

Allah had bestowed humanity with the talent of distinguishinggood from evil and good from bad. Therefore human beings aregifted with the characteristic of embracing and comprehendingreligion and having morality that no any other creature hasgrasped.One of the actions that has been defined and condemned byAllah as the bad action from the first day of creation is adultery.Therefore adultery in Islam has been precisely tackled, and verypowerful and preventive measurements have been brought. Islamconsiders any kind of sexual affair whether between marrieds orbetween singles, -thus without any distinction- in the absence ofmarriage contract between the two, as illegitimate and unlawful.Other than this, while it is seen strong prohibition of any kind ofhomosexuality, which is disgusting and contrary to the humannature, and sexual affair with the deaths, animals, prohibition oflesbianism and masturbation (müsahaka and istimna); meetingthe sexual needs as natural and legitimately, protection of creationand chastity, staying away from any kind of sexual astray andheresy are the main the main messages of the Qur’an. Becauseaccording to Islam, adultery is a crime against humanity, and acalamity that targets to destroy family and society.With the phrases such as adultery of the eyes and adultery ofthe tongue, the sayings of the prophet Muhammad (PBUH)express the high possibility of the process that results withadultery as a result of looking at haram and of sexual contentedcommunications, and he with these sayings aims to protect thebelievers.In addition to its punishment in fiqh as a result of the occurrenceof committing adultery, thanks to precautions in preventing anypossibility of it, adultery has not posed a widespread moralityproblem because of its prohibition and its consideration as a sinin Muslim societies during Islamic history.For a long time, in the Western world in which, gender is dealtwithin the political context, adultery is embraced as a normalrelation with the concept of sexual freedom and it is used aspressure tool today, rather than working to prevent adultery,since 1980s, by going adjustments regarding the children borneas a result of this illegal relations and regarding their fathersand mothers, it is seen the states support single parent familyformations. For the years of millennium, this support goes forlesbians too. In the studies made, it is expressed that rate of adultery is beingwidespread and the number of children as a result of it increaseseach and every year, and people became more insensitive towardsimmoral acts.During the recent years, single parent family structure, which isobserved more as a result of increasing divorces, also has beenrelated with the illicit intercourses cases. It is also observed thatministerial works in Turkey supports this kind of family structure.This article will focus on some family adjustments that legalizeadultery in the West in the 21st century. While the subject isapproached, the creation of the human being as “the noblest ofthe all creation” (eşrefi mahlûk) and the meaning expressed insurah al-Hadid verse 16 will be considered.
