Zeydî Fıkhının Teşekkülüne Katkı Sağlayan Başlıca Fakihler

Özet
Zeyd b. Ali’nin (ö. 122/740) el-Mecmû‘ adlı eseriyle ilk nüveleri atılan Zeydî fıkhı, diğer mezheplerin doğal sürecinde olduğu gibi mezhep fakihleri tarafından geliştirilerek sonraki nesillere aktarılmıştır. Bu bağlamda Zeydî fıkhının gerek kuruluşunda gerek gelişiminde ve gerekse sistematik hale kavuşmasında önemli rol oynayan fakihler bulunmaktadır. Zeydî fıkhının oluşumuna katkı sağlayan başlıca fakihler Kâsım b. İbrâhim er-Ressî (ö. 246/860), Ahmed b. İsa (ö. 247/861), Hasan b. Yahya (ö. 260/873), Hasan b. Zeyd (ö. 270/883), Muhammed Mansûr el-Murâdî (ö. 290/913), Yahya b. Hüseyin (ö. 298/911) ve Ebû Muhammed Hasan b. Ali (ö. 304/917)’dir. Çatı isimlendirme olan Zeydîyye mezhebinde bu imamlardan bazılarının isimlerine nispetle Kâsımiyye, Hâdeviyye, Nâsıriyye ve Mansûriyye gibi fıkıh ekolleri kurulmuştur. Zamanla yok olan bu ekollerden günümüze kadar ulaşan ve halen müntesipleri bulunan tek Zeydî fıkıh ekolü Hâdevîyye’dir. Kâsım er-Ressî’nin ismine nispetle kurulan Kâsımiyye ekolü ise Hâdevî fıkhı içerisinde devam ettirilmişse de Kâsım’ın görüşleri artık ona nispet edilen “Kâsımiyye fıkıh ekolü”nün görüşleri olmaktan çıkmış, Hâdevî fıkhı ile kaynaşmıştır. Bu çalışmamızda Zeydî fıkhının kuruluşuna ve teşekkülüne önemli katkıları bulunan başlıca fakihlerin hayatları hakkında bilgi verildikten sonra kısa bir şekilde başlıca eserleri tanıtılacak ve bunların Zeydî fıkhına yaptıkları katkılar ortaya konmaya çalışılacaktır.
Abstract
Zaydî fiqh whose first cores were laid with the work named al-Mecmû ‘of Zayd b. Ali's (d. 122/740), has been developed by the scholars of the sect and passed on to the next generations, as in the natural process of other sects. In this context, there are jurists who played an important role in the establishment, development and systematization of Zaydî fiqh. Major scholars who have contributed to the formation of Zaydi fiqh, al-Kasim b. İbrâhim ar-Ressî (d. 246/860), Ahmed b. Isa (d. 247/861), Hasan b. Yahya (d. 260/873), Hasan b. Zayd (d.270/883), Muhammed Mansur al-Murâdî (d.290/913), Yahya b. Husayn (d. 298/911) and Abu Muhammad Hasan b. Ali (d. 304/917). In the Zeydîyye sect, which is the roof naming, fiqh schools such as Kasimiyya, Hâdeviyye, Nâsıriyye and Mansûriyye have been established in relation to the names of some of these imams. Of these schools that disappeared over time, the only Zaydi Fiqh School that has survived to the present day and still has followers is the Hâdevîyye. Although the Kasimiyye School, which has been established in relation to the name of Kasim al-Ressî, continued within the Hâdevi fiqh, the views of Kasim HAVE no longer the views of the "Kasimiyye Fiqh School" attributed to him, but HAVE fused with the al-Khadwi jurisprudence. In our study, after giving information about the lives of the main jurists who have contributed to the establishment and formation of Zaydî fiqh, İt will be introduced briefly their main works and try to reveal their contributions to Zaydî fiqh.
