Özet
İcmâ, Hz. Peygamber’in vefatından sonra bir asırda yer alan müctehidlerin dini bir mesele üzerinde ittifak etmeleri şeklinde tarif edilmekte ve ittifak şekline göre sarih ve sükûtî olarak ikiye ayrılmaktadır. Âlimler sarih icmâın ayrıntısına dair olan bazı konularda ihtilaf etseler de temel çerçeveyi oluşturan hususlarda ittifak halindedirler. Sükûtî icmâda ise önemli ihtilaflar bulunmaktadır. İslam Hukuku doktrininde Hanefî ve Mâlikî ekolünden olan usûlcülerin ekseriyeti, Hanbelî ekolünün temsilcileri, Şâfiî ekolünden olan bazı âlimler ve Mutezilî usûlcülerin bir kısmı sükûtî icmâı, icmâın bir çeşidi ve İslam Hukukunun aslî kaynaklarından biri olarak kabul etmektedirler. Ancak Şâfiî ekolünün ekseriyeti, Hanefî ve Mâlikî ekolünden de bazı usûlcüler deliller hiyerarşisinde sükûtî icmâa yer vermemektedirler. Onu icmâın bir türü olarak gören âlimler de sükûtî icmâın oluşum şartları, vakti, katî ve zannî olması gibi birtakım ayrıntılarda ihtilaf etmektedirler. Çalışmada sükûtî icmâın delil olup olmaması ile ilgili ayrıntılara ve ihtilaflara temas edilerek onun kaynak değeri hakkında bir tercihte bulunulacaktır.
Abstract
Ijma, defined as the agreement of the mujtahid in the century after the passage of the Prophet (Pbuh) on a religious issue, is divided into two according to the form of the agreement either as explicit ijma (ijmaʽ sarih/ijmaʽ qawli) or tacit ijma (silent ijmaʽ/ijmaʽ sakuti). Even though scholars disagree on some issues related to the detail of explicit ijma, they are unanimous with the subjects forming the basic framework. However, there are important disputes in tacit ijma. In the doctrine of the Islamic Law, the majority of the scholars from the Hanafi and Malikia schools, the representatives of the Hanbali school, some scholars from the Shafii school, and some of the Mu’tazilah consider it as one of the main sources of the Islamic law. Nevertheless, the majority of Shafii school and some of the Hanafi and Malikia schools do not include tacit ijma in the hierarchy of evidence. Those scholars, who consider tacit ijma as a type of ijma have disputes on a number of details such as the conditions of tacit ijma formation, its time, accuracy, and inaccuracy. The aim of the present is to reach a conclusion about the value of tacit ijma as a resource by providing information about the details and controversies.
