Siyasal Etik Kavramının Söylem Etiği ve Yasal Düzenlemeler Üzerinden Tartışılması: Avrupa Birliği Başkanlığı Etik Davranış İlkeleri ile Etik Komisyonu Çalışma Usul ve Esaslarına İlişkin Yönerge Örneği

Özet
Siyasal etik kavramı, uygun davranış biçimlerinin ve topluluk için iyi olan iş ve eylemlerin kamusal alan içinedahil edilmesini ifade etmektedir. Jürgen Habermas ise, geliştirdiği söylem etiği teorisi ile birlikte, söyleminsiyasal ve etik boyutunu tartışarak, müzakereci bir etik teorisi geliştirmiştir. Bu çalışmada söylem etiği teorisi,siyasi aktör ve kurumlar perspektifinden ele alınmış ve etik davranış ilkeleri “Avrupa Birliği Başkanlığı EtikDavranış İlkeleri ile Etik Komisyonu Çalışma Usul ve Esaslarına İlişkin Yönerge” örneği üzerinden tartışılmıştır.Örnek olarak seçilen yönerge, “Kamu Görevlileri Etik Davranış İlkeleri ile Başvuru Usul ve Esasları HakkındaYönetmelik” baz alınarak incelenmiş ve bu doğrultuda siyasal etik kavramının yasal düzenlemelerle birliktedeğerlendirilmesi hedeflenmiştir. Çalışmanın amacı, siyasi kişi ve kurumlarla-yurttaş arasındaki siyasal etikilişkisini söylem etiği teorisi üzerinden incelemektir. Söylem etiği teorisinin, kamusal alan içindeki etik davranışilkeleriyle olan bağlantısının, yukarıda ifade edilen yönerge örneği kapsamında ele alınması ve söylem etiği teorisikapsamında siyasal etik davranış ilkelerinin değerlendirilmesi amaçlanmıştır. Bu doğrultuda söylem etiğiteorisiyle, kamusal alan içindeki etik davranış ilkelerine yönelik olarak sunulabilecek önerilerin ortaya koyulmasıhedeflenmiştir. Çalışma, siyasal etik davranış ilkelerinin söylem etiği teorisiyle birlikte yasal düzlemde elealınması durumunda, etik ilkelerin yurttaş üzerinde de etkili olarak müzakereci demokrasi ortamının mümkünkılınmasına katkıda bulunabileceği tespiti üzerinde durmuştur.
Abstract
The concept of political ethics refers to the inclusion of appropriate behavior patterns and good deeds and actionsin the public sphere. Jürgen Habermas, on the other hand, developed a deliberative theory of ethics by discussingthe political and ethical dimensions of discourse, together with his theory of discourse ethics. In this study, thetheory of discourse ethics is discussed from the perspective of political actors and institutions, and ethical behaviorprinciples are discussed through the example of the "Ethical Behavior Principles of the Presidency of the EuropeanUnion and the Directive on the Working Procedures and Principles of the Ethics Commission". The directive,which was chosen as an example, was examined on the basis of the "Regulation on Principles of Ethical Behaviorfor Public Officials and Application Procedures and Principles", and in this direction, it was aimed to evaluate theconcept of political ethics together with legal regulations. The aim of the study is to examine the political ethicsrelationship between political persons and institutions and citizens through the theory of discourse ethics. It isaimed to deal with the connection of the theory of ethics of discourse with the principles of ethical behavior in thepublic sphere, within the scope of the above-mentioned directive example, and to evaluate the principles ofpolitical ethical behavior within the scope of the theory of ethics of discourse. In this direction, with the theory ofethics of discourse, it is aimed to put forward suggestions that can be presented for ethical behavior principles inthe public sphere. The study focused on the determination that if the principles of political ethical behavior arehandled on a legal level together with the theory of ethics of discourse, ethical principles contribute to the enablingof a deliberative democracy environment effectively on citizens.
