6102 SAYILI TTK'DA TAŞIMA İŞLERİ KOMİSYONCUSU İÇİN ÖNGÖRÜLMÜŞ YENİ BİR HÜKÜM TOPLAMA YÜK

CONSOLIDATED CARGO : A NEW PROVISION STIPULATED BY THE TURKISH CODE ON COMMERCE FOR FREIGHT FORWARDER

Özet

6102 sayılı TTKnın, çalışma konumuzu oluşturan toplama yükbaşlığını taşıyan 927. maddesi, 6762 sayılı TTKda yer almayan yeni birhükümdür. Anılan maddeye göre taşıma işleri komisyoncusu kendihesabına yapılmış bir taşıma sözleşmesine dayanarak, eşyayı başka birgönderenin eşyasıyla birlikte taşıtma hakkına sahiptir. Komisyoncu, buhakkını kullanırsa, toplama yükün taşınması konusunda taşıyıcının veyataşıyanın hak ve yükümlülüklerine sahip olur . Söz konusu hâlde, taşımaişleri komisyoncusu kendi hesabına hareket ettiğinden, onun taşımayailişkin olarak sorumluluğu TTKnın 928. maddesine göre değil, taşımanın gerçekleştirildiği türe ilişkin hükümlere göre belirlenir.Çalışmamızda, taşıma işleri komisyoncusunun, eşyayı toplama yükhalinde taşıtması durumu ile bunun hukuki sonuçları incelenecektir.

Abstract

The subj ect of our study, Article 927 of the Turkish Code onCommerce aka the law number 6102 which has the title of Consolidated Cargo , is a new provision which was not a part of theprevious Turkish Code on Commerce aka law number 6762. The saidarticle stipulates that the f reight f orwarder is entitled to get the goodstransported together with the goods of another consignor based on acarriage contract made in his name. If the f reight f orwarder uses thisright he would have the rights and liabilities of contract carrier or thetransporter f or the transportation of consolidated cargo . In thissituation liability of the f reight f orwarder should be determined based onthe type of the carriage and Article 928 of the Turkish Code on Commercewould not be applicable as the f reight f orwarder acts on his own name.The consolidated carriage by the f reight f orwarder and its legalconsequences would be reviewed in this study.
