Özet
Marx ve Weber arasında kurulan diyalog, her ikisinin tarihsel analizi ve bununla bağlantılı olarak modern kapitalist toplum değerlendirmeleri arasındaki farkın belirlenmesi ile şekillenir. Söz konusu fark, her ikisinin hukuku ele alma biçimlerinde de ortaya çıkar. Bu bağlamda iki düşünür arasındaki temel ayrımdan beslenen bu çalışma, Roma’daki hukuki biçimlerin modern burjuva toplumuna aktarımının nasıl gerçekleştiği ve bu aktarımın her iki toplumsal formasyonu nasıl ilişkili kıldığına dair saptamalarda bulunur. Çalışmada Roma hukukunun modern burjuva hukukuna mirasının, bir bütün halinde hukuku ve hukuki kavramları tarihsizleştirmeye ve ebedileştirmeye yol açmayacağı, aksi tutumun Weberci tarih anlayışının bir ürünü olacağı ortaya konulmaktadır. Bu tespitin ardından çalışmanın son bölümünde Roma hukuku ile mevcut hukuki biçimler arasındaki ilişkinin, sosyalist toplumda hukuk kurumunun geleceğine dair tartışmalarda nasıl gerçekleşeceği soruşturulmaktadır.
Abstract
The dialogue between Marx and Weber is shaped by the difference between their analysis of history and the modern capitalist societies. The difference arises in the way that the two approach the law as well. Originating from this fundamental difference between the two, this article determines how the transformation of Roman legal forms to modern bourgeois society occurred and how this transformation relates this two social forms to each other. In this study, it is suggested that the legacy of Roman law to modern bourgeois law will not mean to an endless history and eternalization of the law and its legal regulations and that the opposite attitude will be a product of Weberian understanding of history. After this determination in the last part of this article, it is questioned that relationship between Roman law and the existing legal forms will continue in the discussion of the future legal institution of socialist society.
