Fransız Hukuku'ndaki Reform Çalışmaları Işıgında Temyiz İncelemesinin Kapsamı

Özet

Yargıtay içtihat birliğini sağlama görevini üstlenmekte ve hukukilik denetimi yapmaktadır. Kanunların her yerde ve herkes için yeknesak bir şekilde uygulanabilmesi için temyiz incelemesinin kapsamında hâkimin takdir yetkisinin denetlenebilmesi önem taşımakta; bu hususta Fransız Hukuku'ndaki reform çalışmaları da yol gösterici olmaktadır. Bu çerçevede, çalışmamızda hâkimin takdir yetkisinin hangi hallerde temyiz incelemesine konu olabileceği ve buna bağlı olarak hangi hallerde kararın bozulmasının söz konusu olacağı ele alınacak; ayrıca vakıa tespitlerinin temyiz denetimine tâbi olup olmayacağı da inceleme konusu yapılacaktır.

Abstract

Court of cassation is responsible for securing the union of jurisprudence and making the legal control. Discretionary power of judge during cassation review is very important because of the uniform application of the laws for everyone in everywhere. In this respect, reform work in French Law is guiding to Turkish Law. In our article, we will discuss the cases that discretionary power of judge is subject to cassation review and that the judgement will be reversed; we will also observe if determination of fact will be subject to the control by supreme court or not.
